All concepts, designs, drawings, renders, documents, and related materials shared with clients at any stage of engagement are the exclusive intellectual property of Aertsen Living. This includes, but is not limited to, design layouts, 3D visualizations, technical drawings, specifications, and all associated creative outputs developed by the company.
These materials are provided to clients solely for the purpose of evaluation and with the clear understanding that the execution of the proposed designs will be undertaken by Aertsen Living.
No part of the designs or materials shared may be reproduced, replicated, modified, executed, shared with third parties, or used in any manner without obtaining prior written consent from Aertsen Living.
Any unauthorized use, distribution, or implementation of the designs, in part or in full, will be considered a violation of intellectual property rights and may result in legal action in accordance with applicable laws and company policies.
Furthermore, the final Sign-Off Document (SOD) shall be shared with the client upon payment of the 40% of the final Quotation value prior to moving to the Execution stage. A Draft SOD shall be shared to the client prior to execution phase for Approval on the same post which we shall move the project into the Execution stage.
Price Validity
All estimates, quotation and pricing shared by Aertsen Living are subject to the following terms:
Quotation Validity
The prices mentioned in any estimate or proposal are valid for a period of 30 days from the date of issuance of the same.
Any confirmation, booking or project initiation beyond this period will be subject to a revised quotation based on the prevailing rates at the time.
Post Booking Price Validity
Upon payment of the initial Booking Amount, the quoted estimate shall be valid for a period of 6 months. This validity is contingent upon timely design finalization and project progression.
If the project does not move into the Execution phase within this 6-month timeframe, the pricing shall be subject to revision in accordance with the rates applicable at the time of actual project commencement. The previously shared estimate shall then cease to be binding.
In the case of any handover delays (due to any external factor) despite providing an earlier handover date, Aertsen Living reserves the rights to take action on the projects' costing as on a Case-to-case basis. The client is required to send a formal mail informing Aertsen Living of the impending delays with the estimated dates as well to proceed with the project accordingly.
Price Variation Due to External Factors
Prices are subject to revisions in applicable government taxes, duties or statutory levies and significant fluctuations in material costs due to market conditions or unforeseen circumstances.
In such cases, Aertsen Living reserves the right to revise the pricing accordingly with prior information to clients and other stakeholders.
Scope-Based and Site-Dependent Pricing
The initial estimate provided is an indicative cost and subject to refinement. Final pricing will be determined after completion of site measurements and validation and finalization of design details and specifications.
Additionally, components such as Electrical works, Appliances, Accessories, etc are budgetary provisions at the estimation stage. The actual cost for these elements will depend on site conditions, final selections and execution requirements post Validation stage.
Cancellation Policy
We at Aertsen, believe in making every project a beautiful journey and we thrive on delivering on this promise. However, if you change your mind post making the booking payment and wish to proceed with Cancellation, Aertsen will offer a refund as per the terms mentioned below:
- 100% refund shall be offered for cancellation requests made within 48 hours from the date of booking without any deductions. This payment shall be processed within 7 working days.
- The project can be cancelled anytime between Booking and any date before receiving the first cut of 3D visualizations for the residence. A nominal Cancellation Fee of Rs.15,000 (+GST) shall be deducted from the Booking amount and the remaining amount shall be refunded in full. This payment shall be processed within 7 working days.
- 50% value of booking amount can be converted to Store Credits at any point prior to receiving Final Sign-Off Document (SOD), throughout the process of designing. The remaining 50% value shall be absorbed by the organization as Cancellation Fees.
- Please note that any discounts offered while booking the project will not be applicable on the purchase made using Store Credits.
- As the project moves into the production phase after making the Sales Order, Aertsen will not accept any cancellation requests or offer refunds.
- Once the order has been placed, de-scoping of any line item will not be accepted in any type of order including but not limited to Modular, Custom works, Furniture, Appliances and decor etc. No refund, including Store Credit, will be offered post receiving of Final Sign-Off Document. Please note that Store Credits are Non-transferrable and cannot be redeemed by Cash.
Customer Abuse Policy
At Aertsen Living, delivering a high standard of client experience is a core priority. All team members are trained to ensure that every client interaction is handled with professionalism, respect and responsiveness across all stages of the project lifecycle.
While the company is committed to maintaining consistent service quality, there may be occasional and unavoidable challenges such as system interruptions, last-minute changes or policy-related constraints that may temporarily impact timelines or deliverables. Aertsen Living makes every effort to anticipate, minimize and promptly resolve such situations to the best of its ability.
Clients are expected to engage with the company's team in a respectful and professional manner at all times. In situations where concerns arise, clients are encouraged to communicate constructively and allow reasonable time for resolution.
Any form of hostile, abusive, defamatory or inappropriate behavior, whether verbal, written or digital, towards Aertsen Living, its employees or representatives will not be tolerated. In such instances, the company reserves the right to take appropriate action, including, but not limited to:
- Suspension or discontinuation of service
- Termination of the project engagement, thereby rendering all Terms and Conditions null and void
- Initiation of legal proceedings, where deemed necessary
Governing Law and Jurisdiction
All agreements, terms and conditions between the client and Aertsen Living shall be governed by and construed in accordance with the laws of India.
Any disputes, claims or matters arising out of or concerning the engagement, including questions relating to its interpretation, validity or termination, shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
Disclaimers
3D Visualizations
3D visualization images shared during the design process are intended to provide conceptual and visual understanding of the proposed design. While they help illustrate the overall look and feel, they may not precisely represent:
- Final materials, finishes or textures
- Exact dimensions, proportions or detailing
- Natural variations such as wood grains, alignment, etc.
Clients are requested to treat these visuals as Representative Approximations, and not as the exact replicas of the final executed product. Accessories, decor elements and styling shown in 3D views are indicative and may vary in final outcome.
Production Drawings (2D) โ Final Approval
All 2D production drawings, once reviewed and approved by client will be treated as final and binding for execution.
Clients are encouraged to:
- Review all drawings carefully and specifications
- Seek clarifications on any aspect before approval
- Ensure that all requested changes and inclusions have been incorporated
Any modifications requested after approval will be treated as scope changes, and may attract additional costs and impact previously committed timelines.
Design Fee
A Design Fee is applicable on all projects of Aertsen Living. It shall be charged upon the highest Quotation value throughout all design iterations in the Design phase regardless of any change/descoping of work and/or design elements.
The Total Project Value, as finalized and approved at the Design stage ("Designed Value"), shall form the basis for calculation of design fee and any applicable discounts or commercial terms.
The client agrees that the project value shall not be reduced more than 10% of the Designed Value after completion and approval of the design stage.
In the event that the project value is reduced beyond the permissible 10% threshold (Descoping), the following shall apply:
- A charge equivalent to 10% of the differential amount (i.e., the reduction beyond the allowed 10%) shall be levied as additional design fees, payable by the Client.
- Any discounts, promotional pricing, or special commercial offers extended at the time of initial agreement shall become null and void upon such descoping. The project shall thereafter be billed as per standard applicable rates.
Material Readiness and Holding Charges
Once production is completed and intimation for balance payment is shared, materials will be held at the factory for up to 7 working days.
In case of delays beyond this period a holding (demurrage) charge of INR 1,500 per day may be applicable.
If a client wishes to pause production temporarily, a formal request via email (including client name and ID) is required to ensure proper coordination and documentation.
Routine Site Touch-Ups
These are typically addressed during the final painting or finishing stage after installation completion, irrespective of scope allocation.
Since painting services are not part of Aertsen Living's scope, clients are advised to coordinate these touch-ups through their respective vendors.
Site Coordination and Multiple Vendors
These are typically addressed during the final painting or finishing stage after installation completion, irrespective of scope allocation.
If painting services are not part of Aertsen Living's scope, clients are advised to coordinate these touch-ups through their respective vendors unless advised or recommended by site Project Manager.
In cases where multiple vendors are engaged concurrently Aertsen Living will not be responsible for site conditions or damages and quality control and accountability may be impacted.
Clients are advised to plan vendor activities in sequence to maintain smooth execution and avoid conflicts.
